Navigating the ED 1 Ministerial Approval Process for Your Los Angeles Project

In this edition, we delve into the intricate process of submitting an ED 1 project in Los Angeles. Whether you're a seasoned developer or new to the field, our step-by-step guide simplifies this complex procedure.

Step 1: Confirm Project Eligibility

  • First, ensure your project is eligible for ED 1. It should include affordable housing units and meet specific zoning and legislative criteria​​. More specifically, a project should meet all of the following:

    1. The project proposes five or more new units.

    2. The project is not located in a single family or more restrictive Zone (e.g., OS, A1, A2, RA, RE, RS, R1, RU, RZ, RW1).

    3. All units are affordable either at 80% of Area Median Income or lower (HUD rent levels), or at mixed income with up to 20% of units at 120% AMI (HCD rent levels) and the balance at 80% AMI or lower (HUD rent levels).

    4. The project does not require a legislative action (e.g., General Plan Amendment, Zone Change, Height District Change)

    5. The project does not seek a deviation from development standards (e.g., adjustment, variance, specific plan exception, waiver of street dedications and improvements) outside of an affordable housing incentive program.

    6. The project does not require consideration of a Coastal Development Permit.

    7. The project is not subject to the Subdivision Map Act.

Step 2: City Planning Application Form (CP-7771.1)

  • The foundational form for your application, requiring comprehensive project details and the specific entitlements sought​​.

Step 3: Project Team Information

  • List all team members, their roles, and contact details. The primary contact should have an Angeleno Account and be registered with the Ethics Commission​​.

Step 4: Specialized Requirement Forms

  • Complete relevant forms for specific entitlements your project might require, available on the City Planning website​​.

Step 5: Detailed Referral Forms

  • Geographic Project Planning Referral Form (CP-7812): Required for projects within specific plans or overlays, to be signed by the assigned planner​​.

  • Redevelopment Project Area Forms (CP-3541 to CP-3576): Necessary for projects within Redevelopment Project Areas, identifying appropriate review processes​​.

  • HPOZ Authorization Form (CP-3523): Mandatory for sites in Historic Preservation Overlay Zones, to be signed by the HPOZ planner​​.

  • Affordable Housing Referral Form (CP-4043): For projects with affordable housing incentives under various housing programs​​.

  • Transit Oriented Communities Referral Form (CP-4050): Required for projects under the Transit Oriented Communities Program​​.

  • Housing Crisis Act Vesting Preliminary Application (CP-4062): Optional form for vested rights under the Housing Crisis Act of 2019​​.

  • Preliminary Zoning Assessment Form (CP-4064): Facilitates an informational zoning plan check for projects creating residential units​​.

  • Bureau of Engineering Planning Case Referral Form (PCRF): Establishes preliminary right-of-way requirements for commercial, industrial, and multifamily residential projects​​.

  • Hillside Referral Form: Required for projects in hillside areas, obtained from the Bureau of Engineering​​.

  • SB 8 Replacement Unit Determination (RUD) Letter: Determines if affordable replacement units are required for certain housing projects​​.

  • Urban Forestry Referral Form (CP-4070): Needed for projects impacting protected trees or shrubs on-site or in public right-of-way​​.

  • Low Impact Development (LID) PCRF: Reviews how LID requirements may be met based on site conditions​​.

Step 6: Photographs, Maps, and Notification Materials

  • Submit color photographs and an index map of the site and area, and prepare notification materials for stakeholders​​.

Step 7: ZIMAS Reports and Project Plans

  • Include ZIMAS Parcel Profile Reports and detailed project plans, ensuring all plans are to scale and show the necessary details​​.

Step 8: Electronic Copy Submission

  • Provide an electronic copy of all materials on a USB flash drive, with files saved as individual PDFs​​.
